A day at the races is very exciting - the technology, cool cars, excitement of the racing. But few consider what it takes to actually get to that point, including some track owners. Nearly all states within the U.S. feature laws regarding the acquisition and use, particularly the sale, of data. There are enhanced protections for biometric data due to the sensitive nature of the information. Most of these laws fall under a state’s unfair and deceptive trade practices (UDTP). However, what impact, if any, does a state’s data law have if there is a clear and quantifiable cost for violation and a large entity such as Meta, or a pharmaceutical company, will not forfeit all gains for violation of the law?
